Licencing Overview

Licencing philosophy

Our licencing model is inspired by other creative industries and transfers the responsibility for purchasing fonts to the individuals/organisations who commission the design work. The licence holder is the end client who benefits from the font for its business, while the designer obtains the font free of charge for the particular project. This model makes the whole process of purchasing and following the use of the font transparent and straightforward. The price of the fonts is determined by the size of the client/company based on the following structure:

Discounts

We offer our fonts at a reduced price of 30% to Non-Profits, independent galleries, and educational institutions. If your organisation is eligible for the discount, choose the Non-Profit Licence Holder in the checkout and fill a short info on the non-profit cause. For students, we have an exclusive individual discount of 70%. To apply for a discounted license, select Student Licence Holder and use your school email address to complete the checkout. We review the discount requests in less than 24 hours.

Licences

We distinguish between two essential types of licences depending on the file you are working with: OTF (desktop), or WOFF2 (web). You can work across various media with an OTF desktop licence; including printed matter (e.g. books, posters), or on-screen projects (e.g. social media, animation), regardless of how many computers the font is installed on within the same organisation. The web licence includes a WOFF2 file which allows you to embed our fonts on a specific website. OTF and WOFF2 licences which are purchased together are offered at a discount.

Extensions and upgrades

The licences described above are satisfactory for most orders. If you are working on a more expansive design project, please verify that you are purchasing all necessary extensions. The following uses require licence extensions: apps/epubs, trademarks, merchandise, and streaming/broadcasting. If you have exceeded the limitations of your licence or want to upgrade from single styles to the entire family, please contact us for more information.

Trials

We offer trial fonts with basic Western Latin character sets including numbers, and punctuation. Trials are available on the Trial section of our website. Trial font files provided are strictly limited for testing and pitching purposes. By downloading the files, you accept the AllCaps End User Licence Agreement (EULA). If you download the trial files, and would then like to use the font for a published project, your client will need to purchase the appropriate licence.

Modifications

As we care so much about every curve, and spent years refining each family, it is forbidden to modify AllCaps fonts. We regularly work with international agencies, clients, and designers to create customised versions of our fonts for specific needs, including special cuts for branding purposes and extensions into various languages. Please contact us if you are interested in modifications or extensions of any kind.

As our work can have a worldwide public impact, we care about the context in which AllCaps typefaces are used. Using our fonts in any way which spreads hate, racism, or any other form of discrimination is strictly forbidden. Any design work made specifically for political purposes must be approved prior to publishing through written consent of AllCaps.

All sales are final. AllCaps fonts are non-returnable and non-refundable. If a font is defective, notify us within 30 days after purchase and we will provide a suitable replacement.

End User Licence Agreement (EULA)

This End User Licence Agreement is an agreement between you, the Licence Holder, and AllCaps as licensor, specifying the terms and conditions for the Font Software licensed by AllCaps and establishing legally enforceable reciprocal rights and obligations between the parties. The Licence Holder accepts this Agreement and agrees to comply with its terms and conditions. By obtaining a Licence, the Licence Holder acquires only a non-exclusive, non-transferable right to use the Font Software for the purposes specified in this Agreement and in the details completed at Checkout. Any other use requires an additional Licence.

1. Definitions

“Agreement” or “EULA” means this End User Licence Agreement for Font Software, including all information completed at Checkout.

“AllCaps” means AllCaps s.r.o., ID No. 09732802, with its registered seat at Vodičkova 704/36, Nové Město, 110 00 Prague 1, Czech Republic, registered with the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 341849, VAT No. CZ 09732802.

“Licence Holder” means the company, corporation, organisation, or freelancer that uses the Font Software under this Agreement. The Licence Holder is always the end user who benefits from the Font Software; an agency, printer or freelancer producing work for a client is not the Licence Holder but may act on the client's behalf (see "Designer"). The size of the Licence Holder is defined by the number of employees in its organisation, or by the special categories of students and Non-profit organisations. The applicable size categories and their employee thresholds are specified at Checkout and stated on the invoice.

“Non-profit organisations” means legal entities, corporations, funds, or foundations that operate for charitable or educational purposes, scientific or literary purposes, or for a public or social benefit.

“Font Software” means the software provided by AllCaps that generates the Font Outlines. Font Software includes all vector representations of the Font Outlines created by or derived from the Font Software, together with any upgrades, updates, related files and documentation supplied by AllCaps, and any copies or conversions permitted under this EULA.

“Designer” means an external third party such as a studio, agency or freelancer that produces work for the Licence Holder using the Font Software.

“Checkout” means the webpage at allcapstype.com/checkout where the Licence Holder or the Designer enters the licence and usage details; those details appear on the invoice and are binding on all parties.

“Font Outlines” means the typefaces, typographic designs and ornaments contained in the Font Software.

2. Licence Grant

Upon full payment, AllCaps grants the Licence Holder a non-exclusive, terminable, worldwide, and non-transferable licence to use the Font Software in accordance with this EULA. The Font Software can be licensed in the form of OTF (OpenType Font) or WOFF2 (Web Open Font Format). For the purposes of this Agreement, OTF and WOFF2 are considered separate Font Software.

2.1. Licence Types

AllCaps grants the Licence Holder one or more of the following licences or licence extensions based on the Licence Holder’s choice:

2.1.1. Trial Licence

The Trial Licence is intended solely for testing, evaluation, and unpublished pitches. AllCaps may limit the functionality of the Font Software supplied under this licence.

  1. The Licence Holder may install the Font Software on one device and use it only personally. Distribution of the Trial Licence is prohibited. 
  2. The Licence Holder is entitled to use the Font Software to create drafts and unpublished pitch presentations. 
  3. The Font Software may not be used for any published, distributed, or commercial output. Final deliverables to a client require the purchase of the appropriate licence.
2.1.2. OTF Desktop Licence

The OTF Desktop Licence allows creation of non-dynamic documents (e.g. logos, images, identities, books, newspapers, magazines) for print or screen.

  1. The Font Software may be installed and used within the Licence Holder’s organisation.
  2. The Licence Holder is entitled to use the Font Software to create non-dynamic documents for both print and screen, including content published on the Licence Holder's own social media profiles.
  3. The Font Software may be provided to a commercial printer or other pre-press facility only within the scope of a particular project, and only to prepare for printing and to print the Licence Holder's documents, and only for the period necessary to finish that project. Third parties are not allowed to create new documents with the Font Software that has been provided for output only. If any modification to a document is to be made by a person who is not the Licence Holder, a new licence must be purchased. The Licence Holder is obliged to ensure compliance with this EULA by any involved third party.
2.1.3. WOFF2 Web Licence

The WOFF2 Web Licence allows embedding and displaying the Font Software on one website domain owned by the Licence Holder.

  1. The Font Software may be installed and used within the Licence Holder’s organisation.
  2. The Licence Holder is entitled to embed the Font Software on one website domain owned by the Licence Holder, with unlimited traffic. The website domain is specified at Checkout and in the invoice.
2.2. Licence Extensions

Licence extensions are available to Licence Holders who need to expand, for additional uses, the rights granted by a standard OTF Desktop Licence or a standard WOFF2 Web Licence. Such extensions may be obtained via the automated Checkout where available. If an extension is not available for automated purchase, a separate agreement with AllCaps is required.

The provisions of the EULA apply to all Licence Extensions unless otherwise agreed between AllCaps and the Licence Holder. The Licence Holder may not use any extension for purposes other than those expressly permitted for that extension.

The Licence Holder may purchase the following extensions to the Desktop licence:

2.2.1. App/Game/ePub Licence Extension

The App/Game/ePub licence extension grants the Licence Holder the right to embed the Font Software in other specified distributed software (mobile or desktop applications, operating systems, games, ePubs, and e-books) for the purpose of styling dynamic, static, or editable text. The Licence Holder undertakes to have the Font Software embedded in a secure manner such that it cannot be extracted from or accessed outside the specified software.

  1. The Licence Holder may use the Font Software on multiple issues/versions of the same electronic publication/application.
  2. The Font Software may be provided to a developer for the time required to complete a specific project, only for editing and design of the text in the specified application/publication.
2.2.2. Trademark Licence Extension

The Trademark Licence Extension grants the Licence Holder the right to register a logotype featuring the licensed Font Outlines included in the Font Software as a trademark. The logotype featuring the Font Outlines may then appear in any output for perpetual use.

2.2.3. Merchandise Licence Extension

The Merchandise Licence Extension grants the Licence Holder the right to display, in any form, the Font Outlines included in the Font Software on any products intended for commercial and non-commercial (promotional) purposes, such as hardware, clothing and packaging.

2.2.4. Video Licence Extension

This licence extension allows the display of Font Outlines on video media in the context of online streaming services (e.g. YouTube, HBO, Netflix), television broadcast/cable, and cinema/film.

2.3 Unlimited Licence

This type of licence places no limit on the number of the Licence Holder’s employees and can fulfil special requirements that are not covered by the Trial Licence, OTF Desktop Licence, WOFF2 Web Licence or Licence Extensions. The Unlimited Licence is subject to a special offer by AllCaps. The provisions of this EULA apply to the Unlimited Licence unless otherwise agreed between AllCaps and the Licence Holder.

2.4. Non-profit Licence

This type of licence is for Licence Holders who are Non-profit organisations. The Non-profit Licence is subject to a special offer by AllCaps. The provisions of this EULA apply to the Non-profit Licence unless otherwise agreed between AllCaps and the Licence Holder.

2.5. Student Licence

This licence is for students using the Font Software in self-initiated projects during their studies. It may be used only for educational, non-commercial work and is issued on presentation of a valid student ID. If a project is commercialised at any time, an appropriate commercial licence must be obtained. All other provisions of this EULA apply unless AllCaps and the Licence Holder agree otherwise.

This Agreement can be concluded between AllCaps and a Licence Holder who is a consumer only with respect to the Student Licence under Section 2.5 of this EULA.

2.6. Licence Purchase and Other Uses

The licence fee for a particular licence for Font Software is calculated at Checkout and the Licence Holder is aware of the licence fee amount.

  1. The Licence Holder is entitled to use the Font Software only to the extent set forth for the specific type of Licence or Licence extension pursuant to the relevant Sections 2.1 to 2.5 of the EULA and for purposes pursuant to this Agreement. The Licence Holder may not use the Font Software for any other purposes not expressly permitted herein.
  2. If at any time the Licence Holder’s use of the Font Software exceeds the permitted scope of the purchased licence (including an increase in the number of employees beyond the licensed size category), the Licence Holder shall notify AllCaps without undue delay and purchase the appropriate licence. In that case, the Licence Holder pays only the difference between the price already paid and the current list price of the appropriate licence.
  3. The Licence Holder shall ensure that all employees using the Font Software do not commercialise, distribute, or disclose the contents of it to any third party, or use it in any manner other than in accordance with the terms of this Agreement. The Licence Holder will provide technological and security measures to ensure that the Font Software is physically and electronically secured and protected from unauthorised use or access.
  4. All sales are final. The Font Software is digital content supplied immediately upon payment. Purchased licences are therefore non-returnable, non-cancellable and non-refundable, and the Licence Holder is responsible for selecting the correct licence type and format at Checkout.
3. Intellectual Property

The Font Software and the contained Font Outlines and documentation remain the intellectual property of AllCaps. All copyrights in the Font Software, the name of the Font Software, Font Outlines and the Font Software itself, current trademarks and business names, remain the property of AllCaps. The Licence Holder does not acquire any ownership rights in the Font Software. The Licence Holder may not remove or modify any of AllCaps’ copyright notices incorporated in the Font Outlines. The Licence Holder may not share, sell, loan, donate, distribute, reveal or otherwise transfer the Font Software to any third party, unless otherwise expressly specified in this EULA.

4. Designer and Licence Holder Relationship

The Designer may purchase a Font Software licence on behalf of a Licence Holder, but it is the Licence Holder who is the owner of that licence. In this case, the Designer is obliged to ensure that information regarding the Designer’s client is filled in as the Licence Holder and to acquaint the Licence Holder with all the conditions under this Agreement.

The Licence Holder undertakes to inform all authorised users of the Font Software of the scope of the acquired rights of use and the contents of this EULA and to ensure that they are observed and complied with accordingly.

The Designer is entitled to install and use the purchased Font Software within their company under the following conditions:

  1. The Font Software is used to create content only for commercial or non-commercial use of the Licence Holder within the licence granted to the Licence Holder.
  2. The Designer may not use the licence in any circumstances for another client who has not acquired the particular licence.
  3. The Font Software is not to be used for any other purposes not expressly permitted within the purchased Font Software licence. The Designer must comply with all obligations under this EULA which impact the Licence Holder.
  4. The Font Software must be used within the organisation of the Licence Holder and the Designer working for the Licence Holder.
5. Modifications

The Licence Holder may not modify, adapt, or translate the encoding of the Font Software, nor reverse engineer, decompile, disassemble or otherwise attempt to reveal or make available the source code of the Font Software.

All copies that the Licence Holder is permitted to produce under this Agreement must contain the same copyright, trademark, and other proprietary notices as those on or contained within the Font Software.

5.1. AI and Machine Learning
  1. The Licence Holder may not use the Font Software, the Font Outlines or any data derived from them to train or develop any machine-learning or artificial-intelligence model (including font, image and vision models).
  2. The Licence Holder may not use AI or other automated processes to generate, extend or otherwise derive new glyphs, styles, scripts or typefaces from the Font Software, nor upload the Font Software to any service whose terms allow uploaded content to be used for training.
  3. For the avoidance of doubt, the ordinary use of AI-assisted design tools for artwork and layout in which the Font Outlines merely appear is permitted, as long as the output does not reproduce or closely imitate the Font Outlines as a font or as reusable letterform data.
6. Political and Special Use Cases

Use of the Font Software to spread hate, racism or any other form of discrimination is strictly forbidden. In the event of a breach of this condition, AllCaps reserves the right to terminate this Agreement immediately without any refund or compensation to the Licence Holder.

Use of the Font Software in political or politically motivated campaigns and messages in any form, any religious messages (slogans, logos, claims, etc.) or any public use by political parties, political and religious organisations, lobbying institutions, think tanks, etc. (including use for political branding or design purposes) requires the written consent of AllCaps.

7. Warranty and Limitation of Liability

The Licence Holder must inspect the Font Software for obvious defects immediately upon receipt and, if such defects are present, must notify AllCaps without delay, enclosing documentation of the defect; otherwise, any warranty for such defects is excluded. The same applies if such a defect becomes apparent later.

AllCaps cannot warrant the performance or the results that the Licence Holder may obtain by using the Font Software. It is the Licence Holder’s responsibility to ensure that the Font Software is appropriate for the intended purpose.

AllCaps guarantees that the Font Software will be free of defects for 30 days after purchase. Any defects must be notified without undue delay and must include documentation of the defect. AllCaps will repair the defect within 30 days of notification by the Licence Holder.

AllCaps is not obliged to replace Font Software purchased by the Licence Holder, or refund the amount paid by the Licence Holder, if the defect of the Font Software was caused by an accident, misuse, or incorrect use.

In no event shall AllCaps be held liable for any loss or damages caused by using the Font Software, including lost profits, lost data, lost business opportunities, or lost savings. The Licence Holder acknowledges and agrees that neither AllCaps nor its board members, officers, employees, or agents will be liable for any loss or damage arising out of or resulting from AllCaps’ provision of the Font Software under this Agreement, or any use of the Font Software by the Licence Holder or their employees; and the Licence Holder hereby releases AllCaps to the fullest extent from any such liability, loss, damage, or claim.

8. Termination

This Licence Agreement is effective as of the date of full payment for the purchased licence type. This Agreement may be terminated by the Licence Holder at any time by deleting all copies of the Font Software. AllCaps is entitled to terminate this Agreement immediately if the Licence Holder breaches any term of this Agreement. In case of termination of this Agreement by the Licence Holder, no refunds from AllCaps shall be paid.

In case of termination of this Agreement by AllCaps in accordance with this EULA, the Licence Holder may not use the Font Software and has to dispose of all copies of the Font Software as of the end of the notice period. No refunds from AllCaps shall be paid to the Licence Holder.

The Licence Holder warrants that all information provided to AllCaps is true and complete. AllCaps is entitled, not obliged, to check the accuracy of the information provided regarding the type of licence, the size of the Licence Holder, and other information. If AllCaps discovers that the information provided by the Licence Holder is incorrect, or that the use of the Font Software exceeds the purchased licence, and the Licence Holder has not notified AllCaps under Section 2.6(b), the Licence Holder is obliged to pay, as a contractual penalty, the difference between the price of the purchased licence and double the current list price of the appropriate licence. AllCaps will issue an invoice payable within 14 days. This does not affect AllCaps’ right to claim damages.

9. Governing Law

This Agreement shall be governed by, and construed in accordance with, the laws of the Czech Republic. All disputes arising from or related to this Agreement shall be submitted to the exclusive jurisdiction of the Czech court having subject-matter and territorial jurisdiction over AllCaps’ registered seat.

10. Final Provisions

A Licence Holder who is a natural person expressly declares that they are entering into this Agreement within the scope of their business activities, with the exception of Student Licences.

AllCaps reserves the right to modify the terms and conditions of this EULA at any time and without prior notice. Such changes to the EULA are published on allcapstype.com.

All communication between AllCaps and the Licence Holder will be by email. AllCaps will send all documents to the email address provided by the Licence Holder on the Checkout page, and the Licence Holder will address all communication to the following AllCaps email address: mail@allcapstype.com.

The Licence Holder and AllCaps expressly agree that this Agreement will be construed in a manner that renders its provisions valid and enforceable to the maximum extent possible under applicable law.

To the extent that any provisions of this Agreement are determined by a court of competent jurisdiction to be invalid or unenforceable, such provisions will be deleted from this Agreement or modified so as to make them enforceable, and the validity and enforceability of the remainder of such provisions and of this Agreement will be unaffected.
